This site is directed at United Kingdom resident customers only and goods can only be shipped within mainland UK. We reserve the right to refuse to supply our products to you without reason.

GENERAL

The following terms and conditions apply to all purchases made on the www.cuisinart.co.uk web site. Please read them carefully, you may wish to print a copy for future reference.

Use of this website by you, and purchase of any goods from us, is conditional upon your acceptance of these terms and conditions.

These terms and conditions may be changed at any time without the need to let you know. It is therefore your responsibility to check periodically for any changes. Use of our website means you have accepted these terms and conditions. If you do not agree to these Website Terms in their entirety, you MUST NOT use this website.

No other terms and conditions shall apply to the sale of our goods.

These terms and conditions and the purchase by you of any goods from us shall be governed in all respects (including formation and interpretation) by English Law and any dispute arising under or in connection with the foregoing shall be determined through the English Courts.

PURCHASES

a. Orders:

No order for goods shall be binding upon us unless and until accepted by us in writing. We reserve the right to decline any order placed with us in our entire discretion.

b. Availability of Goods:

All goods are subject to availability and may be withdrawn at any time. If for any reason the goods ordered are not available you will be offered an alternative or given a full refund. We will not be held responsible for compensating you for any losses you may suffer if we are unable to supply the requested goods.

c. Description of Goods:

We take care to ensure that details, descriptions and prices within our website are correct but errors may occur and we reserve the right to alter the same at any time.

We also reserve the right to change the specification of the goods we sell.

Every care is taken to reproduce faithfully all product descriptions, however errors may occur. If you are in any doubt about the item you wish to purchase we recommend you contact one of our Customer Care Team to discuss the product in more detail. In the event of a product being listed at an incorrect price due to typographical error, or error in pricing information from our suppliers, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If we have already charged you for the order we will subsequently cancel your order and immediately issue a refund to your account or card.

d. Prices:

All prices quoted are for new goods; prices are in pounds sterling and include all taxes at current rates.

Prices are subject to change at any time before we accept an order from you.

Delivery is included in the price.

e. Delivery:

We use DPD (a division of GeoPost UK Limited).

We aim to dispatch all orders within 5-7 days of confirmation of order or (if later) clearance of payment.

All quoted delivery times are estimates only. Time shall not be of the essence in relation to the delivery of any goods.

All goods shall remain our property (notwithstanding delivery and the passing of risk) until paid for.

f. Payment:

Payments are accepted on most major credit or debit cards via our secure server. All orders are positively credit card sanctioned prior to dispatch. We can accept no responsibility if any order is delayed as a result of incorrectly supplied details.

Credit and debit card numbers are encrypted when your order is placed and are not held in clear text on any web site. All card and payment details are securely processed and we do not see any of these details, we simply receive confirmation that your transaction has been authorised with your nominated card provider. None of your details will be passed onto any third party or used for any other purpose other than those that have been authorised by you.

Please note that the payment will show on your statement under “Conair 01252 813000”.

g. Klarna Payment:

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment methods. Payment is to be made to Klarna.

Pay Later in 30 days: The payment period is 30 days from shipment of the goods or tickets/ availability date of the service. You can find the complete terms and conditions for the markets where this payment method is available here.  

Pay in 3 instalments: With Pay in 3 from Klarna you can pay your purchase in 3 equal instalments. The first instalment will be reserved when the checkout process is complete, and confirmed once the purchase is shipped. Subsequent payments will be taken 30 and 60 days later - the due date in each case will be communicated by Klarna. The payment methods Pay in 30 days and Pay in 3 are only available in case of a positive credit assessment. For this purpose, during the order process and handling of your purchase, we forward your data for an address and credit check to Klarna, and you may need to provide some additional information to allow Klarna to complete their checks. Orders through Klarna are subject to the result of the credit check. Your personal data is handled in accordance with applicable data protection law and in accordance with the information in Klarnas privacy statement, which can be found here. h. Your Invoice:

All goods are supplied with a full invoice giving a description of the goods purchased, the price paid and delivery charges, including VAT.

RETURNS/REFUNDS

The following terms and conditions cover the situations where either (a) the goods are faulty or damaged, or there is a shortfall, on delivery; or (b) you change your mind and wish to return non-faulty goods.

a. The goods are faulty or damaged, or there is a shortfall, on delivery

Where goods are received by you faulty, damaged or there is a shortfall then we must be notified within 30 days of receipt in order for replacement goods to be sent free of charge. No claim will be accepted outside this time limit. Any re-delivery is subject to the safe return of any faulty or damaged goods or (as appropriate) the provision by you of such proof of a shortfall as we may reasonably require. Where we accept liability to provide replacement goods we will refund any reasonable postage charges incurred by you in returning any goods.

All goods are returned to us at your risk

Other than as set out above we accept no liability in relation to faulty or damaged goods, or any shortfall, on delivery.

In no event shall our liability exceed the value of the goods in question.

b. Your right to return non-faulty goods

Private (ie non business) UK customers have certain cancellation rights under the Consumer Protection (The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. For full details the Regulations should be consulted, but in summary:

  1. the right to cancel must be exercised on or before the end of the fourteenth working day following the day after delivery of the goods
  2. notification of the wish to exercise the right to cancel (including your order number) must be received by us as set out in above to:- Conair Customer Care Logistics, Unit 4 Revolution Park, Buckshaw Avenue, Buckshaw Village, Chorley PR7 7DW or by e-mail to: support@cuisinart.co.uk
  3. customers wishing to return non-faulty goods should notify us within 14 days and must arrange to return the goods in a saleable condition (including undamaged packaging) at the address referred to in (2) above as soon as possible. The goods will be deemed returned when actually received by us;
  4. pending return of the goods to us you must keep them in good condition. We reserve the right to refuse to accept a return of goods which have been used (eg cosmetics);
  5. subject to compliance with the foregoing customers will be entitled to a full refund of the price paid to their account or the credit card used (less any deductions in accordance with the foregoing);
  6. Refunding the cost of delivery – Any unwanted goods sent back and received by us within the fourteen day cancellation period, will have the basic delivery cost refunded that was charged when the order was placed, however if you opted for enhanced service e.g. guaranteed next day, we will only refund the basic cost, which is the cost initially charged at order.
  7. certain goods cannot be returned e.g. goods made to the customer’s own specification or perishable goods;-

RETURN OF COUNTERFEIT GOODS

Any items sent to The Conair Group Ltd which are found to be counterfeit goods shall be retained. The Conair Group Ltd will, in return, provide an official document confirming the item/s are counterfeit, which can be used to pursue further action with 3rd parties where applicable.

GUARANTEE

Where not faulty or damaged on delivery (for which see above) all non-disposable items are fully guaranteed for a minimum period of 12 months. Please see the relevant product insert for details.

PRIVACY

The Conair Group Limited collects your personal data in order to process and monitor the product orders that you have placed via our website and to facilitate the management of our after-sales service. Data marked with an asterisk (*) are required to process your order. Your order cannot be processed if you do not provide the required data.

Collected data are processed by our product packaging and shipping service providers, as well as by our hosting service provider, Salesforce , whose servers are located in the United States of America. Collected data are kept for an initial period of 5 years from the date of your order. They are then kept in an intermediate archive for an additional 5-year period (to facilitate any actions related to the monitoring of product quality or safety).

In accordance with the General Data Protection Regulation, you have the right to access, rectify, delete, or object to the processing of your data for legitimate purposes. You may exercise your rights by sending an email to support@cuisinart.co.uk or by addressing a letter to Maplewood, Crockford Lane, Chineham, Basingstoke, RG24 8AL, including a photocopy of your ID.

FORCE MAJEURE

Notwithstanding anything set out in these terms and conditions, we will not be liable for any failure or delay in performance of our obligations if it is due to an event beyond our reasonable control, including, without limitation, acts of God, war, industrial dispute, courier delay, fire, flood, tempest or national emergencies. If so delayed we will be entitled to a reasonable extension of time for performing our obligations. Any dates we specify for the delivery of the goods are only approximate and we shall not be liable for any losses, damages, charges, costs or expenses caused by any delay in delivery of the goods.

INTELLECTUAL PROPERTY

All content available on the Website, including, but not limited to, text, graphics, logos, button icons, images, audio clips, data compilations, and software, and the compilation thereof (collectively the "Content") is and remains the property of Conair, our affiliates, our partners or our licensors, and is protected by United States and international copyright and other intellectual property laws.

The trademarks, logos, and service marks displayed on the Website (collectively, the "Trademarks") are and remain the registered and/or common law marks of Conair, our affiliates, our licensors or our partners, in the United States and other countries, and are protected by United States and international trademark laws. All other Trademarks not owned by us, our affiliates, our partners or our licensors that appear on the Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us.

Except as set forth in the limited license in Section 4 below, or as required under applicable law, neither the Content, the Trademarks, nor any other portion of the Website may be used, reproduced, duplicated, copied, sold, resold, distributed, leased, accessed, modified, or otherwise exploited, in full or in part, for any purpose without our prior written consent. All goods supplied must be used strictly in accordance with any applicable instructions. Except where we are negligent we accept no liability for injury or damage caused by the improper use of any goods.

PROVISO

The exclusions and limitations set out in these terms and conditions do not affect (and are subject to) those of your statutory rights as a consumer which cannot be excluded by Law. For example, under current legislation, liability for Fraud or injury caused by our negligence cannot be excluded.

WEEE Symbol

To remind you that old electrical equipment can be recycled, it is now marked with a crossed-out wheeled bin symbol. Please do not throw any electrical equipment (including those marked with the crossed out wheeled bin symbol) in your bin.

What is WEEE?

The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries to maximise separate collection and environmentally friendly processing of these items. In the UK, distributors (including retailers) must provide a system which allows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. Those establishing their own take-back scheme must as a minimum offer all customers buying new electrical equipment free take back of their old electricals on a like-for-like basis.

The Conair Group Ltd is now officially registered with The Environment Agency as a 'Producer' in the UK Market with an obligation under the WEEE Directive. Our "Producer Registration Number" is WEE/DK0057TS
